The CLIENT agrees to enter into the following agreement with Nirxon Photography (Photographer) for photography services when the book a session with the photographer.

This agreement contains the entire understanding between Nirxon Photography and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing.

The Client agrees to pay photographer 50% of the total cost as deposit, at the time of booking to secure the appointment date and time. This is a non-refundable fee that goes toward the session total. The balance is due the day of the session. The session total covers the time and talent of the photographer, basic retouching and creative editing of the images as determined by the photographer, and digital images (amount depending on session) to be delivered through the online gallery. Additional digital images are available for purchase for £5 each after the photo session. Asking for additional hours of service on the event day will incur £100 per hour for individual service.

Photographer will not guarantee or arrange payment on any location. It is Clients duty to pay any parking, congestion charge or ticket cost during the session period or for the purpose of session. If CLIENT’s chosen location is in outer range of 10 mile radius of photographer location, then CLIENT will pay agreed additional cost for travel.

If an illness or situation prevents a photo session from taking place, the CLIENT may reschedule their session at least 24 hours prior to their shoot without penalty. However, rescheduling on other date depend on photographers availability. Should the CLIENT fail to give a 24 hour notice, or wishes to cancel the photography session, the Deposit stated above shall be retained by the Photographer. The Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond their control. The Photographer will only wait 15 minutes past the session time if the CLIENT is late. The Photographer retains the right to reschedule the session if the CLIENT is past that 15 minute time limit.

Re-shoots are determined at the discretion of the Photographer. Re-shoots will not be given for poor choices of clothing, make-up, hair, or by not following the recommendations of the photographer.

Galleries of Client's images will be available within 15 business days after the session date. Online Galleries are available for 2 weeks to give enough time to display, share, and download the digital files.

The Photographer recommends MPix.com, WHCC, Millers, Smallwoodhome.com and Shutterfly for printing and products. Chain stores such as Tesco, Sainsburys, Asda, M&S, etc do not calibrate their printers resulting in the possibility of poor quality images. The Photographer is not responsible for any injuries inflicted upon any participating parties. CLIENT will be responsible for themselves and their children, and releases the Photographer from any claims against their person or their business.

The Photographer retains all copyrights to all images created during the CLIENT's session. A print release may be given with digital files to print for personal use. The Photographer will not release any RAW image files.

The CLIENT understands and agrees that no additional editing may be done to the images by anyone other than the Photographer. This includes adding filters from social media websites and apps, screenshots (alters the image quality), and any further adjustments not done by the Photographer.

If the CLIENT is unsatisfied with the final delivery of the images they are to contact the Photographer privately. The CLIENT understands that they are not suppose to post on social media in any way slandering Md Nazmul Hossain Nirzon, or Nirxon Photography, or any member of the team.

The CLIENT hereby grants Nirxon Photography and assigns the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT and his/her children may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases Md Nazmul Hossain Nirzon and assigns from all claims and liability relating to said photographs.
